Privacy Policy

YACHTME SAS attaches particular importance to protecting the personal data of visitors and clients of the yachtme-riviera.fr website. This policy sets out what data is collected, why it is collected, how long it is kept and the rights available to each data subject.

It is drawn up in accordance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and French Act No. 78-17 of 6 January 1978, as amended.

Data controller

The data controller is YACHTME SAS, a simplified joint stock company with a share capital of EUR 1,000, whose registered office is at 452, route des Sausses, 06910 Le Mas, France.

Data collected

We collect only the data required for the purposes set out below. Nothing is requested without reason, and most fields offered remain optional.

Contact form. Name, e-mail address, telephone number and the content of your message.

Quotation request. Name, e-mail address, telephone, service required, operating area and any information you choose to provide about your vessel.

Newsletter. E-mail address only, and solely at your express request.

Client area account. Username, e-mail address, password stored in encrypted form, name, telephone, and for business clients the company name, registration number and VAT number.

Vessel record. Vessel name, builder, model, year built, dimensions, type, registration number, flag, home port and berth, MMSI number, engine specifications and hours, insurance company, policy number and expiry date, a photograph of the vessel, and any access instructions you provide.

Service follow-up. Intervention reports, photographs taken before, during and after our work, documents and certificates you upload to your area, requests submitted online and quotations approved.

Subscriptions. If you subscribe to a concierge plan online, payment data is collected and held exclusively by our payment provider. It never passes through our servers, and we retain only a technical identifier linking your subscription to your account.

Browsing. Technical and audience measurement data: IP address, browser type, pages visited, time spent. This data is collected only after your consent has been obtained, by means of cookies.

Purposes and legal bases

Your data is processed for the following purposes.

Responding to your enquiries and issuing quotations, on the basis of your consent and of pre-contractual steps taken at your request.

Managing your client account, providing technical follow-up of your vessel and performing the agreed services, on the basis of performance of the contract.

Preparing our visits properly, by knowing the characteristics and access constraints of your vessel, on the basis of performance of the contract.

Establishing evidence of the condition of the vessel and of the work carried out, in particular through photographs, on the basis of our legitimate interest in ensuring traceability and defending our rights in the event of a claim.

Managing invoicing and subscriptions, on the basis of performance of the contract and of our legal obligations.

Sending you information about our services, on the basis of your consent, which may be withdrawn at any time.

Measuring website traffic and improving the site, on the basis of your consent.

Complying with our accounting, tax and legal obligations, on the basis of a legal obligation.

Recipients

Your data is intended solely for the staff of YACHTME SAS handling your file, and for technical providers acting on its behalf and under its instructions: website host, e-mail service, payment provider, audience measurement tool.

Where the performance of a service requires it, strictly relevant information may be passed to a subcontractor working on your vessel, such as a yard or a specialist technician, limited to what is necessary for their task.

Your data is never sold or transferred to third parties for commercial purposes.

Photographs and video

Our work gives rise to photographs and, where applicable, video recordings of the vessel, its equipment and the areas concerned. This material is used solely to document the apparent condition of the vessel, to evidence the work carried out, to assist technical follow-up and to establish proof of our findings in the event of a claim, proceedings or an insurance notification.

It is never disclosed to third parties or used for commercial or advertising purposes without your prior, express and written consent, unless it has been anonymised so that neither the vessel nor its owner can be identified.

Hosting and data location

The website and the data it contains are hosted by o2switch, 222-224 boulevard Gustave Flaubert, 63000 Clermont-Ferrand, France. The servers are located within the European Union.

The subscription payment provider may be established outside the European Union. In that case, transfers are governed by the standard contractual clauses adopted by the European Commission.

Retention periods

Enquiries submitted through the forms are kept for three years from the last contact.

Client account and vessel record data is kept for the duration of the contractual relationship, then for three years from the last contact.

Intervention reports, photographs and uploaded documents are kept for the duration of the contractual relationship, then until the expiry of the limitation periods applicable to any claim the company may need to defend.

Accounting records and invoices are kept for ten years, in accordance with the French Commercial Code.

Audience measurement data is kept for a maximum of thirteen months.

Newsletter subscriptions are kept until you unsubscribe.

Cookies

The website places cookies that are strictly necessary for its operation, in particular to maintain your session when you are logged into the client area and to remember your cookie choices. These cookies do not require your consent.

Audience measurement cookies and, where applicable, cookies placed by third-party services are used only after your consent has been obtained through the banner displayed on your first visit.

You may change your choices at any time via the cookie management link on the website, or configure your browser to refuse some or all cookies. Refusing strictly necessary cookies may impair certain features, in particular access to the client area.

Installable application

The website can be installed as an application on your device. Doing so stores a local copy of the pages you have visited on your device, so that they can be displayed without a connection. This data remains on your device and is not transmitted to us. It is removed when you uninstall the application or clear your browser data.

Security

YACHTME SAS implements appropriate technical and organisational measures to protect your data: secure HTTPS connection, passwords stored in encrypted form, access restricted to authorised staff only, and separation of client accounts so that each can access only its own data.

Your rights

Under applicable law, you have the right of access, rectification, erasure, restriction of processing, data portability and objection, together with the right to issue directions concerning the fate of your data after your death. Where processing is based on your consent, you may withdraw it at any time.

These rights may be exercised by e-mail to contact@yachtme-riviera.fr or by post to the registered office. Any request must be accompanied by proof of identity. A response will be provided within one month of receipt.

If you consider that your rights have not been respected, you may lodge a complaint with the French data protection authority (CNIL), 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, France, or at www.cnil.fr.

This policy may be updated to reflect legal, technical or service developments. The date of the latest update appears below.
